A functioning legal system is vital to democracy in Afghanistan. Without a legal system that reaches the whole country, the state is just an empty promise. Justice in the districts of Afghanistan are still heavily influenced by traditional beliefs and procedures. Yet, most reform interventions have focused on the formal or state system and not on the traditional systems. Whereas there may be positive elements in traditional justice mechanisms in terms of providing a community based and accessible means of resolving disputes, some elements of traditional justice, particularly as it deals with the rights of women and children, may be difficult to reconcile with state justice and with Afghanistan’s international human rights treaty obligations. Most Afghans have only limited knowledge of their rights and how to exercise them.
Therefore through this project AHEAD's aim is to improve access to justice at the Sholgara, Dehdadi, Khulum and Nahri Shahi districts level especially for disadvantaged and marginalized groups, who either don’t have access to legal and judicial systems of the country or, who have are completely un-aware of the existence of these institution Continue development of a system of governance based on the rule of law and the promotion and protection of the human rights of the Afghan people in order to reinforce national unity, as laid down in the Afghan Constitution.
Intended area of Interventions:
- Capacity building/Awareness raising programme for Community Leaders.
- Capacity building Programme for justice officials.
- Increase justice awareness and skills of religious leaders.
